A household has been fined £400 after paying for an unlicensed operator to dispose of their domestic waste.

The litter was dumped in a layby in Winterbourne Monkton, near the Avebury World Heritage Site in Wiltshire.

An inspection by environmental enforcement officers found evidence that related to the Swindon resident.

Councillor Caroline Thomas said the Council issued more fixed penalty notices (FPN) and prosecuted more fly-tippers in 2023 than ever before.

"We take fly-tipping very seriously here in Wiltshire," added the councillor.
Obtain a receipt

The council fined the resident because they could not demonstrate they had "sufficiently taken steps to ensure their waste was being disposed of legitimately by a registered waste carrier".

The person admitted they had not requested to see a waste carrier's licence, nor did they record vehicle details or obtain a receipt, according to the Local Democracy Reporting Service.

If they had been able to give council officers details of who took their waste from them, they could have avoided the fine and the investigation would have been targeted towards the person who dumped the waste.
'Be extra vigilant'

Ms Thomas, cabinet member for transport and street scene, said the council had invested an extra £150,000 a year into tackling the "environmental crime".

"With Christmas approaching, we urge householders to be extra vigilant when paying someone to take any waste away and to make sure they check they have a valid upper tier waste carrier licence; note their vehicle registration, make and model; and get a receipt or waste transfer note."

She said anyone who reports a fly-tipper could receive a reward of up to £200 in high street vouchers "if the information leads to the successful prosecution of an offender or the payment of a FPN".

Is there no facility for challenging the peremptory and arbitrary
decisions of the council's officers by taking the matter to be
determined by a court which is rather better versed in judging the
correct probabilities of the matter and more amenable to reason and less
concerned with raising income for the council?

And why would any household pay £400 for disposal of their household
waste when the local council has that job and must provide the service
free at the point of use (as quid pro quo* for their receipt of
swingeing amounts of local taxes)?

Meanwhile, fines for fly-tipping will increase from £400 to £1,000 or £800 if paid early. Fines for graffiti, including putting up posters without permission, will increase from £100 to £500, with early payment reducing that figure to £400.

In July, the government introduced new legislation allowing councils to increase penalties for environmental offences. ENDS

Council chiefs say new increased fines for fly-tipping across Lichfield and Burntwood will send out a “strong message” to those thinking of dumping their rubbish.

The new fixed penalties will rise from £400 to £1,000 from 1st April – with the fee reducing to £500 for early payment.

Those who don’t pay could receive a prison sentence and fine imposed by a court.

Lichfield District Council cabinet member Cllr Alex Farrell said:

“People in Lichfield District are incredibly proud of our local environment, and the council is doing all it can to keep it clean and green.

“We’re lucky to have some dedicated volunteer groups, Particularly the Lichfield Litter Legends, doing fantastic work to keep our streets and public places free of litter.

“These increases to fixed penalties will send a strong message that offences like fly-tipping and littering will not be tolerated locally.

“The revenue from fixed penalties goes back into funding more enforcement activity, and those who don’t pay face a much larger penalty in court along with a criminal record.”
Other changes will see littering fixed penalties rise from £150 to £500 – reduced to £250 for early payment – while householders who do not check if their waste has been taken by a registered carrier will now be hit with a £600 charge instead of £200.

The council’s fixed penalty charges for graffiti and fly-posting have also increased.

Hull City Council is urging residents to make use of the multiple waste schemes and services available this festive season, following six substantial fly-tipping fines this month.

In the separate incidents, the offenders were caught dumping waste in Dover Street, Plane Street, Dee Street, Hessle Road, and twice in Kings Bench Street.

Fly-tipping is defined as the ‘illegal deposit of any waste onto land that does not have a license to accept it’. People who are caught fly-tipping will be fined £400 (£1,000 from Monday 1 January 2024) or prosecuted with the possibility of an unlimited fine and the recovery of clean-up costs.

In light of the recent fines, Hull City Council is continuing to warn residents to dispose of their waste responsibly through the services provided.

Councillor Julia Conner, Portfolio Holder for Environment, said: “Fly-tipping is a crime; therefore, the Council take offences very seriously. These fines could easily be avoided, if people disposed of their waste correctly.

“At this time of the year, we understand it is a busy one for many residents. But as we all enjoy the festivities, it is important to remember that excess waste and recycling still needs to be disposed of in a sensible manner.

“There are a number of services, schemes, and waste centres Hull residents can use to ensure waste is disposed of correctly and our environments are kept clean.”

Services and schemes the council provide to dispose of waste include:

For large items residents can use the bulky household collection scheme.. Households are eligible for one free collection per year of up to five items which can include cookers, dishwashers, fridges, mattresses, sofas etc.
There are three household waste and recycling centres located across the city, open every day from 10am – 5pm, which residents can use free of charge. All are modern facilities, designed to maintain and improve recycling within the city. White electrical goods in working order can be donated and/or collected free of charge to be sold at a discounted price in the Reuse Electrical Shop – a joint initiative with Dove House Hospice, ERYC and FCC Environment that aims to keep white goods in use for as long as possible.

Amsterdam could make a fortune, a welcome £15million a year, from FPNing
canal bicycle-chuckers.

They could spend the money on a campaign for dietary health, as cycling
doesn’t seem to do much to improve things in the health area.

More than 800 fly-tipping and littering fines have been imposed by a Lincolnshire council since March.

South Holland District Council said more than 100 Fixed Penalty Notices (FPNs) were handed out in November alone.

The environmental crimes included fly-tipping, spitting, littering and dog-fouling.

Of those fined, 20 people were prosecuted in November for failing to pay, the council said.

Twenty people were prosecuted at Boston Magistrates' Court on 2 and 11 November with all given the same penalty of a £220 fine, plus costs and a victim surcharge totalling another £200, the authority said.

The 109 FPNs given in November - three for fly-tipping, 11 for spitting and 95 for littering - mean since March, the total number of FPNs has risen to 812.

South Holland District Council said enviro-crimes like these "blight communities" but officers were doing "fantastic work" to tackle them.

Councillor Anthony Casson, portfolio holder for public protection, said the council would not tolerate the issue "anywhere in South Holland".

He added: "We will continue to do our upmost to protect our towns, villages, waterways and countryside and bring those responsible to justice."

Penalties for environmental crimes were increased in August to deter would-be offenders living and visiting South Holland, the council said.

Bracknell Forest Council have agreed to double the penalty for fly-tipping following an increase in incidents across the borough.

The £200 fine will increase to £400 and come into effect on January 2, 2024. The money will be used to help tackle further offending for waste-related crimes.

The new penalty will also apply to anyone in control of a vehicle who allows that vehicle to be used for fly-tipping.

The Section 34 ‘duty of care’ offence penalty has also been increased from £200 to £300.

This applies when someone allows someone unlicenced to remove or carry waste to do so.

Cllr Iskander Jefferies said, “The increase in penalties is part of a package of measures that includes public information and engagement, CCTV and of course enforcement.

"Our aim is to send a clear message to this involved in this criminal behaviour that we take fly-tipping and the failure to ensure your waste is disposed of correctly, very seriously.

"This behaviour damages our environment and leaves law abiding residents with the clean-up bill’.

"Residents need to take steps to ensure their waste is disposed of correctly. This includes simple steps such ensuring that those you pay to remove your waste hold the relevant licences and leave the relevant documentation."

In some cases, fly-tipping can also be prosecuted in the criminal courts and those convicted can face unlimited fines, or in the case of offences under Section 33 up to two years imprisonment.

A fly-tipper who dumped construction waste at the back of houses, causing a fire risk, has been tracked down and handed a £1,000 fine following a CCTV appeal by Telford & Wrekin Council.

Through Telford and Wrekin Watch – an initiative launched by the council to tackle the scourge of fly-tipping – an appeal was made on social media to trace the owner of an unregistered van.

The vehicle had been caught on camera tipping a load of wood and tiles in an alleyway in Urban Gardens, Wellington, in September. Footage showed a man directing the driver as he reversed the Ford Transit into the alleyway and shamelessly tipped the waste. The pile of rubbish posed a fire risk to nearby houses and had the potential to attract vermin.

Following the appeal, which went out last month, the council received information and as a result the owner of the van has been given a £1,000 fixed penalty notice which they have 28 days to pay. Failure to do so could result in prosecution.

Councillor Richard Overton, Deputy Leader of Telford & Wrekin Council and Cabinet Member for Homes and Enforcement said:

“This is an excellent example of how residents can join forces with the council in the fight against fly-tipping and bring offenders to justice.

“We set up Telford and Wrekin Watch to raise awareness of how to report fly-tips and to ask community-minded people to help us identify those who dump waste on our streets without a care.

“This successful appeal shows the council will use every tool to catch fly-tippers and make them accountable for their actions.

“We are doing all we can to prevent fly-tipping by educating residents about how to properly dispose of their rubbish but there is a minority who think it’s acceptable to leave it wherever they like. Unfortunately, it is the majority of law-abiding taxpayers who foot the bill and we want to put a stop to that.”

Residents are urged to report fly-tips on the My Telford app.

To help put a stop to fly-tipping, anyone with information that could identify a perpetrator is urged to call the council’s confidential number on 01952 388800.

The council also encourages people to visit Telford and Wrekin Watch and sign up for the latest appeals and success stories.
