I need to track the following:

A decision of the Divisional Court of the High Court, Taber v MacDonald
and Clockscreen Holdings Ltd (1999) 31 Housing Law Reports73, at page 78.

Google managed to find the Housing Law Reports at about £2,300 but nothing
else turned up and https://www.bailii.org/ doesn't turn anything up. It's
about what supporting documents a landlord needs to provide in respect of
service fees in a leased property.

I went to the County Court a couple of days ago to try and get a case
transferred to the First-tier Tribunal (Property Chamber). The judge said
the case couldn't be transferred but she would issue a stay and give me a
month to make an application to the FTT (very stern about that) so I'm
hustling!

Any advice appreciated :-)

You just need to find a library that has Housing Law Reports in stock.
Or subscribe to an online service.

The libraries of universities with law departments allow access by
external users which might be ok if they have a physical subscription
to the service required, not if they have an online subscription thats
only accessible by registered students and accademics.

I believe the information you want from that case is covered in the book
"Commercial and Residential Service Charges" authored by Adam Rosenthal,
Elizabeth Fitzgerald, Oliver Radley-Gardner, Nathanial Duckworth, and
Philip Sissons published by Bloomsbury Publishing on the 31st May 2013.

I've just checked and, unfortunately, we don't have a copy in chambers. :-(

However, if you use this link
https://www.gov.uk/search-library-catalogue you may be able to find a
copy in a local library. (I'd recommend the largest library in the city
closest to you as they're more likely to have a copy but that likelihood
is lower than I would like it to be.)

Failing that, Abe Books have a copy for the princely sum of £80 plus
shipping.

For context, it is £205 new, which is less than 10% of the costs of the
Housing Law Reports you need. :-( and :-) respectively.

S.P.

Just to thank you for all the replies so far, I will follow them up.

The case in question relates to how much information a landlord has to
provide in response to a request for supporting documents under S22 of the
Landlord & Tenant Act 1985. I am a step behind that because my landlord
has refused to allow me the facility to inspect the supporting documents
and the only remedy is to persuade the local authorities to prosecute but
(a) they have other things to do and (b) that still doesn't get you the
documents.

It's dreadful legislation, in force for nearly 40 years and no record of
any proceedings against a landlord probably because it's a waste of time
and the only case law the one I am searching for.
