The overturning of the death penalty, both federally and in the applicable State of California, is rather more complex than most newspaper reporters portray it. In fact, it WASN'T the SCOTUS that rescued the late Manson, the now-freed Van Houten and their three confederates from San Quentin's gas chamber, but rather the California Supremes, though both legal tracks culminated in 1972. Then only months thereafter, Golden State voters would end up having their own say.

The pivotal California case was California v. Anderson decided in April, while the Federal action was Furman v. Georgia settled in late June, though California voters would reinstate executions--though not conduct one again until the widely-publicized Robert Alton Harris case in 1992--by amending their State Constitution via the ballot initiative process with Proposition 17 in November 1972, passing it with a better than a 67% majority.

(Sorting out the competing and conflicting legal doctrines of the overlapping jurisdictions of the various cases applicable here is not merely is difficult for us legal laymen--or at least for little ol' onetime civil-law paralegal me--but also makes me terribly glad I abandoned my own half-hearted idea of pursuing law school after graduating college, instead sticking with broadcasting. (If YOU can reach a crystal-clear understanding of all this after even a couple readings of everything below, then you're way smarter than me; actually, you're probably way smarter than me anyway.)

Oh, and the fortunate Ms. Van Houten turns out to have had THREE trials when all was said and done prior to her starting her now-truncated prison stretch.

I herewith correct the header that you merely acknowledged needed correction.

Van Houten having spent the time from leaving her teens to becoming a septuagenarian in captivity,
we can turn to the remaining incarcerated "family"...Debra Tate used to have a website noting the
next parole hearing dates for each but I can't seem to find it now (she has showed up for decades
to testify in the negative,having been a teenager when her sister Sharon was killed [not by Van
Houten]).

As I understood it California inmates used to have the intervals between their hearings set by
the parole board at up to fifteen years but the Mansonites seem to be getting another crack every
year or two now...Patricia Krenwinkel is apparently up again in November and I'm not sure who
wants to see her turned loose (she was at both killings,and at the La Bianca scene told Van
Houten what to do).

I'm not sure why Gerald Mason (not a Mansonite,given two consecutive life terms after 45 years
on the run from killing the 2 cops who pulled over the stolen car in which he was making his
getaway from the gunpoint rape of a 15-year-old girl) was given a parole hearing before he
finished the FIRST of his CONSECUTIVE life terms,but they kicked him 15 years down the road
from that one and he didn't live that long.

I think Tex Watson is up for a hearing next year.

This is frightening news. Now I'm all scared and shit. I mean I
can't sleep thinking about it, how Leslie is out there right now
and how, who knows, I might be next on her list. Will she kill
again? Nope, she got it all out of her system with Tate and
LoBianco. Of course had she not been caught she'd have killed
again. But she was caught. Same with OJ Simpson. People
call him a killer. He is not a killer, he is just a guy who happened
to kill two people one time. He got it out of his system. In some
ways I wonder if released killers might in some ways be the
least dangerous people to hang around with. It's like after a
store has been robbed nobody wants to go there - they're scared.
But in reality, especially now that it's been robbed, it might be
the safest place in town, at least for one night.

Thanks. I can't boast of my analysis because that's pretty
much all I've done pretty much every day for most of my
life, sit around analyzing things. No, honestly, more lately
than ever. But I do analyze a lot of shit. Sometimes I may
not even believe in whatever my analysis determines. I jus
enjoy analyzing stuff. Maybe more so, I don't so much enjoy
it as I feel I have to do it.

Yes, as for JFK, when people used to ask me who or what
I think was behind his death I say, "I don't know, just as long
as I don't see him coming down the street tomorrow." Once
they're dead it's good they stay that way. In the meantime I
can't deny it - even though I was in favor of Van Houtem's
release - just for the fun of it - there is a part of me that hopes
she kills again - just for the fun of it. The old John Henry Abbot
syndrome. Remember him? The guy who wrote "The Belly of
the Beast" when he was in prison. I think it was for murder.
Norman Mailer and a few other notables got behind Abbot and
lobbied for his release. It took a few years but they finally won.
Abbot was released. Got a job in Greenwich Village waiting
tables where he later got into an argument with a patron and
wound up killing him in a struggle. I have often wondered if
maybe the patron had some kind of aggressive chip put into
his brain and was sent to the restaurant purposely to pick a
fight with Abbot - to provoke Abbot so he would kill again. Just
to prove Mailer and his friends wrong. It would be fun to read
about Leslie flipping out and killing a bunch of halfway house
residents. Ok, if not fun at least interesting.
